Quick guide: Section 113C ACT ka 17% adjusted accounting-income calculation, corporate tax comparison aur excess carry-forward worked example.

Alternative Corporate Tax ka basic rule

Section 113C mein covered company ke liye corporate tax aur Alternative Corporate Tax, yani ACT, ka comparison hota hai aur higher amount relevant liability banta hai. Is provision ko har individual, sole proprietor ya partnership par apply na karein. Pehla step company aur income ki scope check karna hai; doosra step correct figures compare karna hai.

Corporate tax ki definition sirf accounts mein tax expense nahi. Section 113C(2)(c) relevant Division II tax aur applicable minimum tax mein higher amount ko use karta hai. Income subject to a separate tax regime ko bhi bina classification ke isi comparison mein combine nahi karna chahiye.

17% kis amount par lagta hai?

ACT adjusted accounting-income base ka 17% hai. Starting point financial statements ka profit before tax hai. Equity method ke under recognised associate share accounting-income definition se excluded hai. Section 113C(7) expense allocation aur subsection (8) excluded income categories ko address karte hain.

Exempt income, specified income taxed outside the relevant corporate/minimum-tax scope, aur subsection (8) mein listed qualifying credit income ko read karein. Exclusion sirf income line delete karne ka shortcut nahi: related expenses ki allocation bhi matter karti hai. Accounting profit after tax ya bank balance ko ACT base na banayein.

Illustrative calculation

Assume working papers ke baad adjusted ACT base PKR 10,000,000 establish hua. ACT = 10,000,000 × 17% = PKR 1,700,000. Relevant normal corporate tax PKR 1,200,000 aur applicable minimum tax PKR 1,400,000 assume karein. Corporate tax comparator higher amount, yani PKR 1,400,000, hai. ACT higher hone ki wajah se section 113C comparison ka result PKR 1,700,000 hota hai.

ACT excess = 1,700,000 − 1,400,000 = PKR 300,000. Yeh figures method samjhane ke assumptions hain; normal corporate ya minimum-tax rate ka general statement nahi. Advance payments aur withholding credits ko separately reconcile karein. Do calculations ko add karke PKR 3,100,000 banana double counting hoga.

Excess carry-forward ka record

Subsections (4) aur (5) ACT ke corporate tax se excess ko following years ke specified Division II tax ke against carry-forward/adjustment ka framework dete hain. Maximum period original excess year ke immediately succeeding ten tax years hai. Isay immediate cash refund ya har tax head ke against unrestricted credit na samjhein.

Har origin year ke liye opening excess, current-year adjustment, amended assessment effect aur remaining balance ka register rakhein. Subsection (6) ke mutabiq underlying tax calculation change ho to carry-forward figure bhi change ho sakta hai. Minimum-tax carry-forward aur ACT carry-forward ko separate schedules mein track karein.

Kaun se taxpayers aur amounts separately check honge?

Subsection (9) Fourth, Fifth aur Seventh Schedules ke mutabiq chargeable taxpayers ko exclude karta hai. Exemptions aur special regimes ko entity ke actual facts se match karein. Section ke end ki explanation separately payable taxes ko unki prescribed treatment par rakhti hai; ACT comparison un taxes ko erase nahi karta.

Commissioner accounting income ko historical accounting pattern ke mutabiq adjust karne ka power use kar sakta hai, opportunity of being heard ke saath. Is liye one-off accounting classification change ka contemporaneous business reason aur supporting evidence hona chahiye.

Accounts team ki practical checklist

Signed financial statements, profit-before-tax reconciliation, equity-method income detail, excluded-income analysis, expense-allocation basis, normal/minimum tax working aur ACT history prepare karein. Kya 17% har company ka final corporate rate hai? Nahi. Yeh specified ACT comparison ka rate hai; scope aur other taxes alag check honge.
