Is episode mein hum Pakistan ke sab se common aur practically important heads of income mein se ek ko detail mein samjhein ge: Income from Salary.

Agar aap salaried employee, accountant, HR professional, tax practitioner, student ya taxpayer hain, to Section 12 aur salary withholding rules ko samajhna accurate tax calculation aur return filing ke liye bohat important hai.

Episode 3 Mein Kya Seekhein Ge?

  • Section 12 — Salary ki legal definition aur scope
  • Section 13 — Perquisites ki valuation
  • Section 14 — Employee Share Schemes
  • Section 149 — Employer ke through salary tax withholding
  • 75% Rule — Salaried tax rates qualify karne ka criterion
  • Tax Year 2027 Salary Tax Slabs
  • Section 4AB — TY 2027 salaried surcharge position
  • Zakat, Donations aur VPS jaise relevant tax relief concepts
  • Practical salary tax calculation

Section 12 — What is Salary?

Income Tax Ordinance, 2001 ke Chapter III, Part II mein Section 12 salary income ki main statutory provision hai.

Salary sirf monthly basic pay ka naam nahi hai. Employment relationship ke sabab employee ko milne wale mukhtalif cash aur non-cash benefits taxable salary ka hissa ban sakte hain.

Salary Mein Kya Kya Shamil Ho Sakta Hai?

  • Basic Salary / Pay
  • Wages
  • Leave Pay
  • Overtime Payments
  • Fees
  • Commission
  • Bonus
  • Allowances
  • Certain Gratuity or Employment-related Payments
  • Taxable Perquisites
  • Employee Share Scheme related taxable amounts
Important ITO Point:

Section 12 ka ek important principle yeh hai ke employee ko salary income earn karne ke liye personally incurred expenditure ki general deduction allowed nahi hoti.

Yani business income ki tarah employee apne personal commuting, clothing ya routine employment expenses ko automatically salary se deduct karke taxable salary reduce nahi kar sakta.

Employee, Employer & Employment — Basic Legal Concepts

Salary taxation ko samajhne ke liye employment relationship identify karna bohat important hai.

  • Employee: Employment relationship mein services provide karne wala individual.
  • Employer: Woh person/entity jo employee ko employ karta aur remuneration provide karta hai.
  • Employment: Traditional job ke ilawa certain offices, directorships ya management positions bhi relevant statutory conditions ke mutabiq employment scope mein aa sakti hain.

Section 13 — Perquisites: Non-Cash Benefits Bhi Taxable Ho Sakte Hain

Employee ko employer sirf cash salary hi nahi deta. Kabhi employer vehicle, accommodation, loan ya doosri facilities provide karta hai. In benefits ko tax law mein generally perquisites ke concept ke through deal kiya jata hai.

Section 13 ka purpose taxable perquisites ki value determine karna hai. Applicable valuation rules ke mutabiq perquisite ki taxable value salary income mein include ho sakti hai.

Common Examples

  • Employer-provided accommodation
  • Motor vehicle facility
  • Interest-free ya concessional loan
  • Utilities ya other employer-provided benefits
  • Certain personal expenses paid by employer
Important:

Har allowance ya benefit automatically exempt nahi hota. Taxability relevant statutory provision, Second Schedule exemption, valuation rule aur specific facts par depend karti hai.

Section 14 — Employee Share Schemes

Modern companies employees ko salary ke ilawa shares, stock options ya employee share schemes bhi provide kar sakti hain.

Section 14 employee share schemes se arising taxable amounts ke treatment ko regulate karta hai.

Applicable circumstances mein employee ko milne wale shares ki fair market value aur employee ki acquisition cost ke difference ka tax impact arise ho sakta hai.

Practical Relevance:

Startup employees, senior corporate executives aur multinational company employees ko employee stock options / share schemes receive karte waqt Section 14 ko ignore nahi karna chahiye.

Section 149 — Employer Salary Tax Kaise Deduct Karta Hai?

Section 149 salary se withholding tax deduction ka main provision hai.

Employer employee ki estimated annual salary income aur applicable rates ko consider karke tax calculate karta hai aur salary payments se tax deduct karta hai.

  1. Estimated Annual Salary
Employer employee ki estimated annual taxable salary determine karta hai.
  2. Applicable Tax Rates
Relevant Tax Year ke First Schedule salary rates apply kiye jate hain.
  3. Annual Tax Estimate
Estimated salary par annual income tax calculate hota hai.
  4. Monthly Withholding
Employer annual liability ko salary payment cycle ke mutabiq deduct karta hai.
  5. Year-End Adjustment
Bonus, salary revision, previous short/excess deduction aur permissible adjustments ke sabab employer remaining months mein deduction adjust kar sakta hai.
Important Distinction:

Section 149 withholding tax deduction ka provision hai. 75% salaried criterion technically Section 149 mein create nahi hota. Salaried tax rates ki eligibility First Schedule ke relevant provisions ke through determine hoti hai.

75% Rule — Who Qualifies for Salaried Tax Rates?

Pakistan ke income tax rate structure mein salaried individuals ke liye separate concessional tax slabs available hote hain.

Salaried tax rates generally us individual ke liye relevant hote hain jiski income chargeable under the head Salary uski taxable income ka 75% se zyada hissa constitute karti ho.

Example A — Salaried Category

Total Taxable Income = Rs. 2,000,000

Salary Income = Rs. 1,600,000

Salary percentage = 80%

Result: 80% salary income hone ki wajah se individual salaried rate criteria meet karta hai.

Example B — Salaried Threshold Not Met

Total Taxable Income = Rs. 2,000,000

Salary Income = Rs. 1,400,000

Other taxable income = Rs. 600,000

Salary percentage = 70%

Result: Salary taxable income ka 75% se zyada hissa nahi hai. Is situation mein salaried concessional rate table ki eligibility affected ho sakti hai aur applicable non-salaried framework check karna zaroori hota hai.

Tax Year 2027 — Salary Tax Slabs

Finance Act 2026 ke baad Tax Year 2027 ke liye salaried individuals ke progressive income tax slabs revise kiye gaye hain.

Annual Taxable Income Tax Year 2027 Rate
Up to Rs. 600,000 0%
Rs. 600,001 to Rs. 1,200,000 1% of amount exceeding Rs. 600,000
Rs. 1,200,001 to Rs. 2,200,000 Rs. 6,000 + 11% of amount exceeding Rs. 1,200,000
Rs. 2,200,001 to Rs. 3,200,000 Rs. 116,000 + 20% of amount exceeding Rs. 2,200,000
Rs. 3,200,001 to Rs. 4,100,000 Rs. 316,000 + 25% of amount exceeding Rs. 3,200,000
Rs. 4,100,001 to Rs. 5,600,000 Rs. 541,000 + 29% of amount exceeding Rs. 4,100,000
Rs. 5,600,001 to Rs. 7,000,000 Rs. 976,000 + 32% of amount exceeding Rs. 5,600,000
Above Rs. 7,000,000 Rs. 1,424,000 + 35% of amount exceeding Rs. 7,000,000
Progressive Tax System Ko Samjhein:

Agar taxpayer higher slab mein enter karta hai to higher percentage poori income par apply nahi hota.

Fixed tax lower slabs ka accumulated tax represent karta hai aur higher percentage sirf specified threshold se exceed karne wale amount par apply hota hai.

Practical Salary Tax Example

Assume karein annual taxable salary: Rs. 1,500,000

Relevant TY 2027 formula:

Rs. 6,000 + 11% of amount exceeding Rs. 1,200,000

Excess Income:

Rs. 1,500,000 − Rs. 1,200,000 = Rs. 300,000

11% of Rs. 300,000 = Rs. 33,000

Total Annual Tax:

Rs. 6,000 + Rs. 33,000 = Rs. 39,000

Approximate monthly withholding before other applicable adjustments:

Rs. 3,250 per month

Section 4AB — Salaried Surcharge Position for TY 2027

Section 4AB surcharge rules high-income individuals aur AOPs ke liye important hain.

Finance Act 2026 ke baad Tax Year 2027 ke salaried individuals ke liye salary surcharge withdraw kar diya gaya hai.

Yeh distinction important hai kyun ke previous tax years mein high-income salaried individuals ke liye surcharge treatment different tha.

Tax Year Matters:

Old tax year ki surcharge rate ko current Tax Year 2027 par automatically apply na karein. Return filing aur withholding calculation mein hamesha relevant tax year ka applicable law use karein.

Allowances, Exemptions & Tax Reliefs

Salary income calculate karte waqt taxpayer ko taxable salary aur legally available exemptions / reliefs ke darmiyan difference samajhna chahiye.

Medical Allowance / Medical Benefits

Medical allowance ya employer-provided medical treatment ka tax treatment relevant statutory exemption aur conditions par depend karta hai. Applicable Second Schedule conditions ko check karna zaroori hai.

Section 60 — Zakat

Applicable law ke mutabiq qualifying Zakat payment deductible allowance ke taur par relevant ho sakti hai.

Section 61 — Charitable Donations

Qualifying charitable donations par applicable conditions ke subject to tax credit available ho sakta hai.

Section 63 — Approved Pension Fund / VPS

Approved Pension Fund / Voluntary Pension Scheme mein qualifying contribution par Section 63 ke under applicable tax credit claim kiya ja sakta hai, subject to statutory conditions and limits.

Common Salary Tax Mistakes to Avoid

  • Sirf basic salary ko taxable salary samajhna aur taxable allowances ignore karna.
  • Employer-provided perquisites ko completely ignore kar dena.
  • Bonus aur arrears ko annual salary calculation mein include na karna.
  • 75% rule ko Section 149 ka direct rule samajhna.
  • Previous Tax Year ke salary slabs current year mein use karna.
  • Salary ke against personal expenses ki unauthorized deductions claim karna.
  • Employer withholding ko final return liability samajh lena without annual reconciliation.
  • Other taxable income ko disclose na karna.
