Agar aap landlord, property owner, tenant, accountant, tax practitioner, real estate professional ya taxpayer hain, to rental income ki chargeability, allowable deductions aur withholding tax rules ko samajhna accurate tax compliance ke liye bohat important hai.
Episode 4 Mein Kya Seekhein Ge?

- Fair Market Rent rule
- Forfeited deposits ka tax treatment
- Sub-letting ka Section 39 treatment
- Building with Plant & Machinery ka tax treatment
- Section 15A — Allowable Deductions

Section 15 — Income from Property
Section 15 ke tehat land ya building se owner ko milne wala rent received ya receivable, subject to applicable exemptions, Income from Property ke head mein chargeable hota hai.
Yahan ek important point yeh hai ke taxability sirf us rent tak limited nahi jo cash mein receive ho chuka ho. Relevant law ke mutabiq receivable rent bhi tax computation ka part ban sakta hai.
Rent Ki Legal Meaning
Rent se murad woh amount hai jo land ya building ke:
- use,
- occupation, ya
- right to use or occupy
ke consideration mein owner ko receive ya receivable ho.
Forfeited Deposit / Biana Ka Tax Treatment
Section 15 ke rent concept mein ek important provision forfeited deposit se related hai.
Agar land ya building ki sale ke contract ke tehat buyer ne deposit ya earnest money / biana diya ho aur contract cancel hone ki wajah se owner woh amount forfeit kar le, to applicable Section 15 framework mein yeh amount property income ke treatment mein aa sakta hai.
Practical Point:Landlord ya property seller ko forfeited deposits ko automatically capital receipt samajh kar ignore nahi karna chahiye. Relevant facts aur Section 15 ka treatment check karna zaroori hai.
Fair Market Rent Rule — Actual Rent Kam Ho To Kya Hoga?
Section 15 ka ek bohat important aur aksar miss hone wala rule Fair Market Rent se related hai.
Agar property ka actual rent uske fair market rent se kam ho, to applicable circumstances mein taxpayer ko fair market rent derive karne wala treat kiya ja sakta hai.
Important:Property ko artificially low rent par show karna hamesha taxable property income ko automatically reduce nahi karta.
Section 15 ke fair market rent provisions ko rent agreement aur return preparation ke waqt zaroor consider karein.
Property Income vs Income from Other Sources
Har property-related receipt Section 15 ke under Income from Property nahi hoti.
1. Sub-Lease / Sub-Letting
Agar tenant kisi land ya building ko aage sub-let karta hai to tenant legal owner nahi hota.
Sub-lease se derived rent generally Section 39 — Income from Other Sources ke under chargeable hota hai.
2. Building Together with Plant & Machinery
Agar building ko plant aur machinery ke sath lease kiya gaya ho, to relevant rent Section 15 ke bajaye Income from Other Sources ke head mein chargeable ho sakta hai.
3. Amenities, Utilities & Connected Services
Agar property rent mein utilities, amenities ya kisi connected service ka separate amount included ho, to aise service-related amount ka treatment Section 39 ke under Income from Other Sources mein ho sakta hai.
Simple Rule:Owner ka pure land/building rent generally Section 15 mein, jabke sub-letting, certain services aur building-with-machinery arrangements Section 39 ki taraf ja sakte hain.
Section 15A — Allowable Deductions
Gross rental income hi hamesha final taxable property income nahi hoti.
Section 15A qualifying property owner ko specified expenditures aur allowances claim karne ki ijazat deta hai.
Applicable deductions claim karne ke baad net taxable property income determine ki ja sakti hai.
| Deduction | Section 15A Treatment |
|---|---|
| Repair Allowance | Building ke rent chargeable to tax ka 1/5th yani 20% allowance. |
| Insurance Premium | Building ko damage ya destruction ke risk se insure karne ke liye qualifying premium. |
| Local Rates, Taxes & Cesses | Property ya rent ke relation mein local authority / government ko paid or payable qualifying amounts, excluding income tax under the Ordinance. |
| Ground Rent | Property ke relation mein paid or payable qualifying ground rent. |
| Profit on Borrowed Money | Property ko acquire, construct, renovate, extend ya reconstruct karne ke liye qualifying borrowed money par profit. |
| Mortgage / Capital Charge Interest | Qualifying mortgage ya other capital charge par paid interest / profit. |
| Administration & Collection Expenses | Wholly and exclusively rent derive karne ke liye qualifying expenditure, rent ka maximum 4%, including administration and collection charges. |
| Legal Expenses | Property ke title ko defend karne ya property-related court suit ke liye qualifying legal services expenditure. |
| Irrecoverable Rent | Certain statutory conditions fulfil hone par genuine unpaid / irrecoverable rent ki deduction. |
Har expense ko sirf is liye deduct nahi kiya ja sakta kyun ke woh property se related hai.
Expense ko Section 15A ki applicable category aur conditions satisfy karni chahiye aur supporting record / evidence maintain karna chahiye.
Irrecoverable / Unpaid Rent
Agar tenant rent pay nahi karta to Section 15A certain conditions ke subject to unpaid rent ki deduction allow kar sakta hai.
Relevant conditions mein generally bona fide tenancy, tenant ke vacate karne ya vacation ke steps, recovery ke reasonable efforts aur pehle rent ko taxable income mein include karna jaise requirements important hoti hain.
Important:Sirf tenant ke rent delay karne se automatic bad-debt deduction available nahi hoti. Statutory conditions satisfy karna zaroori hai.
Practical Property Income Calculation
Farz karein Mr. Ahmed ki commercial property ka annual data yeh hai:
- Gross Annual Rent: Rs. 1,000,000
- Repair Allowance — 20%: Rs. 200,000
- Local Taxes / Ground Rent: Rs. 30,000
- Qualifying Mortgage Profit: Rs. 70,000
Step 1 — Gross Rent
Rs. 1,000,000
Step 2 — Total Allowable Deductions
Rs. 200,000 + Rs. 30,000 + Rs. 70,000
= Rs. 300,000
Step 3 — Net Property Income
Rs. 1,000,000 − Rs. 300,000
= Rs. 700,000
Result:Example ke assumptions ke mutabiq taxable property income Rs. 1,000,000 ke bajaye Rs. 700,000 hogi.
Section 16 — Non-Adjustable Security Deposit
Rental properties mein landlord aksar tenant se security deposit, advance ya koi non-adjustable amount receive karta hai.
Agar owner ko building ke relation mein tenant se aisa amount milta hai jo rent ke against adjustable nahi hai, to Section 16 ke under us amount ka special tax treatment ho sakta hai.
Relevant rule ke mutabiq non-adjustable amount ko:
- receipt wale tax year, aur
- uske baad ke nine tax years
mein equal proportion mein rent ke taur par treat kiya jata hai.
Simple Example
Agar landlord ko:
Rs. 1,000,000 non-adjustable amount
receive hota hai, to basic Section 16 principle ke mutabiq amount ko 10 tax years mein equal proportion mein spread kiya ja sakta hai:
Rs. 100,000 per tax year
Important:Refund, tenancy termination aur succeeding tenant se new non-adjustable amount receive hone ki situation mein Section 16 ke further adjustment rules apply kar sakte hain.
Section 155 — Withholding Tax on Rent
Section 155 immovable property ke rent payment par withholding tax deduction se related hai.
Har ordinary tenant automatically withholding agent nahi hota. Law mein specified prescribed persons par rent payment ke waqt tax deduct karne ki responsibility hoti hai.
Prescribed Persons Mein Kaun Aa Sakta Hai?
- Federal Government
- Provincial Government
- Local Government
- Company
- Non-profit organization / charitable institution
- Foreign diplomatic mission
- Specified private institutions and businesses
- Individual ya AOP paying gross annual rent of Rs. 1.5 million or above
- Any other person notified under applicable law
Tax Year 2027 — Section 155 Rent Withholding Rates
Individual aur AOP landlord ke liye basic Section 155 withholding slabs gross annual rent ke reference se apply hote hain.
| Gross Annual Rent — Individual / AOP | Basic Section 155 Withholding |
|---|---|
| Up to Rs. 300,000 | Nil |
| Rs. 300,001 to Rs. 600,000 | 5% of amount exceeding Rs. 300,000 |
| Rs. 600,001 to Rs. 2,000,000 | Rs. 15,000 + 10% of amount exceeding Rs. 600,000 |
| Above Rs. 2,000,000 | Rs. 155,000 + 25% of amount exceeding Rs. 2,000,000 |
Company Landlord
Where the recipient / landlord is a company, the basic Section 155 rate is:
15% of gross amount of rent.
ATL / Taxpayer Status:Actual withholding may also be affected by applicable Active Taxpayer List / Tenth Schedule rules. Current tax year and taxpayer status should therefore be checked before practical deduction.
Is Section 155 Withholding Final Tax?
No. Section 155 deduction should not simply be treated as the landlord's final income tax liability.
Applicable framework ke under rent se deducted tax generally adjustable tax / tax credit ke taur par annual income tax liability ke against adjust hota hai.
Simple Example
Agar tenant ne landlord ke rent se:
Rs. 100,000 tax deduct
karke FBR ko deposit kiya, to landlord annual return prepare karte waqt relevant tax deduction ko apni total applicable liability ke against tax credit ke taur par reconcile karta hai.
Do Not Confuse:Section 155 WHT gross rent payment par source deduction hai, jabke landlord ki ultimate annual income tax liability uski applicable taxable income aur tax framework ke mutabiq determine hoti hai.
Common Property Tax Mistakes to Avoid

- Below-market rent show karke Fair Market Rent rule ignore karna.
