Section 18 — Income from Business
Section 18 Income Tax Ordinance, 2001 ke under Income from Business ki main charging provision hai.
General rule ke mutabiq kisi person ke business se derive hone wale profits aur gains, jab tak kisi specific provision ke under exempt na hon, Income from Business ke head mein taxable hote hain.
Business Income Mein Kya Kya Shamil Ho Sakta Hai?
- Trade ya commercial activity se profits and gains
- Profession ya vocation se business income
- Trade, professional ya similar association ki certain receipts
- Tangible movable property ko hire ya lease karne ki income
- Business relationship ke sabab milne wala certain benefit or perquisite
- Certain management fees
- Certain cases mein profit on debt, jahan taxpayer ka business hi aisi income derive karna ho
- Specified financial / leasing business receipts
Har receipt jo bank account mein aati hai woh automatically business income nahi hoti, aur har commercial-looking receipt ko kisi doosre head mein transfer bhi nahi kiya ja sakta.
Correct classification taxpayer ki activity, legal nature of receipt aur relevant section par depend karti hai.
Business Benefit or Perquisite Bhi Taxable Ho Sakta Hai
Section 18 sirf cash sales ya service receipts tak limited nahi hai.
Agar kisi person ko past, present ya prospective business relationship ki wajah se koi taxable benefit ya perquisite milta hai, to applicable circumstances mein us benefit ki Fair Market Value business income ka hissa ban sakti hai.
Practical Example:Agar business liability ka koi portion waive ho jaye ya business relationship ki wajah se koi measurable economic benefit receive ho, to uska tax treatment check karna zaroori hai.
Section 19 — Speculation Business
Income from Business chapter mein Section 19 speculation business ko separately deal karta hai.
Speculation business ko ordinary business se distinct aur separate treat kiya ja sakta hai aur speculation losses ke liye bhi separate rules apply hote hain.
Why It Matters:Ordinary trading loss aur speculation loss ko automatically same treatment dena correct nahi hota. Relevant loss adjustment provisions ko separately check karna chahiye.
Section 20 — Allowable Business Deductions
Section 20 business deductions ka core principle provide karta hai.
Business income compute karte waqt expenditure tab deductible ho sakta hai jab woh:
Wholly and exclusively for the purposes of business
incur kiya gaya ho, subject to Income Tax Ordinance ki doosri conditions aur restrictions.
Common Examples of Potential Business Expenses
- Business premises rent
- Electricity and utility expenditure
- Employee salaries and wages
- Business-related travelling
- Freight and carriage
- Office expenses
- Advertising and marketing expenses
- Professional fees
- Business insurance
- Repair and maintenance of business assets
- Qualifying finance costs
Sirf expense ka accounts mein record hona enough nahi hai.
Expense ko Section 20 ka business-purpose test meet karna chahiye aur Section 21 ya kisi doosri provision ke under disallowed nahi hona chahiye.
Capital Expenditure vs Revenue Expenditure
Business taxation mein sab se common mistakes mein se ek capital expenditure ko normal expense samajh kar poora amount immediately deduct karna hai.
| Type | Example | General Tax Treatment |
|---|---|---|
| Revenue Expenditure | Routine business electricity, rent, normal repairs, office expenses | Applicable conditions fulfil hon to current tax year mein deduction available ho sakti hai. |
| Capital Expenditure | Machinery, vehicle, equipment, long-term business asset | Normally immediate full deduction nahi; relevant depreciation / allowance provisions apply karte hain. |
| Intangible Asset | Certain licences, rights or qualifying intangible expenditure | Relevant Section 24 amortisation rules apply kar sakte hain. |
| Pre-commencement Expenditure | Business start hone se pehle qualifying setup expenditure | Section 25 ke treatment ke mutabiq amortisation applicable ho sakti hai. |
Sections 22–25 — Business Assets Ka Tax Treatment
Agar business expenditure kisi depreciable asset, intangible ya pre-commencement expenditure se related ho, to Section 20 ke under uska poora amount simply immediate expense claim nahi kiya jata.
Relevant circumstances mein:
- Section 22 — Depreciation
- Section 23 — Initial Allowance
- Section 24 — Intangibles
- Section 25 — Pre-commencement Expenditure
ke provisions apply kar sakte hain.
Simple Concept:Current operating expense aur long-term asset purchase ka tax treatment same nahi hota.
Section 21 — Deductions Not Allowed
Section 20 allowable expenditure ka general rule deta hai, lekin Section 21 specifically batata hai ke kaun se expenses business accounts mein maujood hone ke bawajood tax deduction ke liye disallow ho sakte hain.
| Expense / Situation | Tax Treatment |
|---|---|
| Income Tax on Business Profits | Business profit par levied income tax generally deductible business expense nahi hai. |
| Personal Expenditure | Owner / taxpayer ke personal expenses business deduction nahi hain. |
| Fines & Penalties | Law, rule ya regulation ki violation par paid fines or penalties generally deductible nahi. |
| Capital Expenditure | Except where specific depreciation / amortisation provisions apply, capital expenditure direct business deduction nahi. |
| Withholding Tax Non-Compliance | Certain expenditure disallow ho sakta hai agar required tax deduct / collect aur deposit na kiya gaya ho. |
| Unapproved Employee Funds | Certain contributions unrecognized / non-approved funds ko deductible nahi hote. |
| AOP Payments to Members | Certain profit on debt, brokerage, commission, salary ya remuneration paid by an AOP to its member disallowed ho sakti hai. |
| Cash / Non-Banking Payments | Section 21 ke specified banking-channel requirements violate hone par certain expenditures disallow ho sakte hain. |
| Non-Compliant Salary Payments | Specified monthly salary threshold se above payment required banking / digital mode ke baghair deduction issue create kar sakti hai. |
Business Payments — Banking Channel Rules
Section 21 ke under payment mode bhi tax deductibility par effect daal sakta hai.
Current statutory framework mein taxpayer ko large business transactions ke liye proper banking channel maintain karna bohat important hai.
Important Compliance Point:Specified expenditure under a single account head agar aggregate mein Rs. 250,000 se exceed kare, to applicable Section 21 banking-channel requirements ko check karna chahiye.
Law mein certain exceptions bhi hain, including specified small payments aur utilities, freight, travel fare, postage aur statutory payments.
Companies ke liye relevant provisions mein notified business bank account se digital means ka requirement bhi applicable ho sakta hai.
Salary Payment Compliance
Business salary expense claim karte waqt sirf salary expense book karna enough nahi hota.
Current Section 21 framework mein an individual employee ko Rs. 32,000 per month se zyada salary specified banking / transfer mode ke baghair pay ki jaye to deduction affected ho sakti hai.
Best Practice:Employee salary direct bank transfer, crossed cheque ya applicable digital mode se pay karein aur payroll / withholding records maintain karein.
Withholding Tax Compliance & Business Expenses
Pakistan ke tax system mein business expenditure aur withholding compliance closely linked ho sakte hain.
Agar kisi payment par law tax deduct ya collect karne ki responsibility impose karta hai aur taxpayer required tax properly deduct / deposit nahi karta, to relevant expenditure ki tax deductibility affect ho sakti hai.
Important:Vendor invoice genuine hone ke bawajood withholding non-compliance Section 21 ke under tax adjustment / disallowance ka risk create kar sakti hai.
Section 29 — Bad Debts
Business mein har receivable recover nahi hota.
Section 29 qualifying bad debts ke liye deduction rules provide karta hai, subject to statutory conditions.
Bad debt ko simply outstanding invoice keh kar deduction claim nahi kiya ja sakta; relevant accounting treatment, prior income recognition aur recovery conditions ko check karna zaroori hota hai.
Section 32 — Method of Accounting
Business tax computation taxpayer ke accounting method se bhi linked hoti hai.
Income Tax Ordinance ke mutabiq taxpayer ka business income generally regularly employed accounting method ke basis par compute hota hai.
Important:Companies generally business income ko accrual basis par account karti hain, jabke other persons relevant provisions ke subject to cash ya accrual basis use kar sakte hain.
Section 35 — Stock-in-Trade
Trading aur manufacturing businesses ke liye stock valuation taxable profit par direct effect dalti hai.
Opening stock, purchases / production cost aur closing stock ka correct calculation business income determine karne mein important role play karta hai.
Practical Point:Incorrect closing stock valuation se taxable business profit materially overstate ya understate ho sakta hai.
Practical Business Income Calculation
Farz karein ek business ka annual data yeh hai:
- Gross Business Revenue: Rs. 5,000,000
- Cost of Goods / Allowable Purchases: Rs. 2,000,000
- Employee Salaries: Rs. 600,000
- Business Rent & Utilities: Rs. 300,000
- Other Qualifying Business Expenses: Rs. 200,000
Step 1 — Total Revenue
Rs. 5,000,000
Step 2 — Qualifying Deductions
Rs. 2,000,000 + Rs. 600,000 + Rs. 300,000 + Rs. 200,000
= Rs. 3,100,000
Step 3 — Illustrative Net Business Income
Rs. 5,000,000 − Rs. 3,100,000
= Rs. 1,900,000
Result:Illustration ke assumptions ke mutabiq tax calculation ka business income base Rs. 5 million gross receipts ke bajaye Rs. 1.9 million ho sakta hai, subject to all deductions actually satisfying the law.
Section 20 vs Section 21 — Simple Difference
| Section 20 | Section 21 |
|---|---|
| Business-purpose expenditure ko general deduction principle provide karta hai. | Specific expenses aur situations ko deduction se restrict / disallow karta hai. |
| Question: Expense business ke liye wholly & exclusively incurred hua? | Question: Expense genuine hone ke bawajood Section 21 ki kisi restriction mein to nahi aa raha? |
| Potentially allowable. | Potentially inadmissible / disallowable. |
Business expense claim karte waqt pehle Section 20 ka test apply karein aur uske baad Section 21 ki restrictions check karein.
Business Losses & Carry Forward
Agar allowable deductions business income se zyada ho jayein to business loss arise ho sakta hai.
Income Tax Ordinance mein business losses ke set-off aur carry-forward ke separate rules hain.
Relevant Section 57 framework ke under qualifying business loss ko specified conditions ke subject to future business income ke against carry forward kiya ja sakta hai, generally up to six succeeding tax years.
Important:Speculation loss aur normal business loss ko same treatment nahi milta. Speculation loss ke liye Section 58 ke separate rules check karein.
