Assalam-o-Alaikum! AM Tax Hub ki Income Tax Ordinance, 2001 — A-to-Z Master Series ke Episode 12 mein aapka khair-maqdam hai.
Pakistan ke income-tax system mein withholding tax sirf tax collection ka aik procedure nahi. Businesses, companies aur other prescribed persons ke liye yeh aik important legal responsibility bhi hai.
Jab koi prescribed person supplier, service provider ya contractor ko payment karta hai, to relevant circumstances mein usay payment se tax deduct karke Government Treasury mein deposit karna hota hai. Import ke case mein Section 148 ke tehat Customs stage par tax collect kiya ja sakta hai.
Agar tax deduction, collection, deposit ya reporting mein default ho, to withholding agent ko Sections 161, 162 aur 205 ke under financial consequences face karne pad sakte hain.
Is episode mein hum withholding tax se le kar audit aur amendment of assessment tak ka legal process easy Roman Urdu mein samjhein ge.

Section 148 — Advance Tax on Importation of Goods
Section 148 Income Tax Ordinance, 2001 ke under import stage par advance income tax collection ka framework provide karta hai.
Import clearance ke waqt Collector of Customs importer se prescribed rate par tax collect karta hai.
Tax Collection at Customs Clearance
Current Section 148(1) ke mutabiq tax un imported goods par collect kiya jata hai jo Ordinance ke Twelfth Schedule ke Parts I, II aur III mein classified hon.
Applicable rate First Schedule ke Part II mein specified hota hai.
Is liye import withholding tax determine karte waqt product ka correct PCT / tariff classification, Twelfth Schedule category aur relevant Tax Year verify karna zaroori hai.
Import Value for Tax Purposes
Section 148 ke under tax calculation ke liye relevant import value Customs Act, 1969 ke valuation framework se linked hai.
Applicable case mein Customs-assessed value ke sath customs duty, sales tax aur Federal Excise Duty jaisi relevant amounts bhi calculation base ka hissa ban sakti hain.
Minimum Tax vs Industrial Undertaking's Own-Use Imports
Import tax ka treatment har importer ke liye same assume nahi karna chahiye.
Current Section 148(7) ke under tax generally importer ki imports se arising income par minimum-tax treatment rakhta hai.
Lekin statutory exception mein industrial undertaking ke woh goods relevant hain jo undertaking apne own use ke liye import karti hai.
Section 148(7A) — Specified Goods:Current law kuch specified categories ke imports ko separately minimum-tax treatment deta hai, including:
- Edible oil
- Packaging material
- Paper and paper board
- Plastics
Board ko statutory procedure ke mutabiq specified list mein amendment karne ka power bhi diya gaya hai.
Important Legal Clarification:Har industrial import automatically adjustable tax nahi hota aur har commercial import ko sirf aik generic rule ke through classify nahi kiya ja sakta.
Imported goods ki schedule classification, importer ka use, applicable exception aur relevant Tax Year separately check karein.
ATL Status & Import WHT
Importer ki Active Taxpayer List status applicable withholding rate ko affect kar sakti hai.
Lekin non-ATL treatment ko har import transaction mein automatically “double tax” kehna accurate nahi. Applicable First Schedule, increased-rate provisions aur product classification check karna zaroori hai.
Practical Import Compliance
- Correct PCT / Customs classification verify karein.
- Twelfth Schedule part identify karein.
- Relevant First Schedule rate check karein.
- Industrial undertaking ke own-use status ka evidence maintain karein.
- Minimum-tax treatment under Section 148(7) / 148(7A) review karein.
- Customs GD, assessment and payment records preserve karein.
- Advance tax credit / adjustment treatment relevant tax computation mein verify karein.
Section 153 — Withholding Tax on Goods, Services & Contracts
Section 153 local business transactions par withholding tax deduction ka important provision hai.
Jab koi prescribed person relevant payment kisi resident person ko karta hai, to prescribed circumstances mein tax deduct karna hota hai.
Payment full ho, partial ho ya advance payment ho, transaction ki legal classification aur applicable withholding rules check karna zaroori hai.
Three Main Transaction Categories
| Section | Transaction | Common Example |
|---|---|---|
| 153(1)(a) | Sale / Supply of Goods | Raw material, manufactured products, office supplies and commercial goods |
| 153(1)(b) | Rendering / Providing Services | Consultancy, accounting, legal, engineering and other qualifying services |
| 153(1)(c) | Execution of Contracts | Construction, engineering, execution and other qualifying contracts |
1. Supply of Goods — Section 153(1)(a)
Jab prescribed person kisi resident supplier ko goods ki payment karta hai, to Section 153(1)(a) ke under withholding tax deduction required ho sakti hai.
Is category mein commercial goods, manufactured products aur toll-manufacturing related transactions bhi relevant ho sakti hain.
Goods payment ka gross amount determine karte waqt Section 153(2) ko bhi consider karein, kyun ke sale of goods ke gross amount mein applicable sales tax include hota hai.
2. Services — Section 153(1)(b)
Resident service provider ko payment karte waqt Section 153(1)(b) relevant hota hai.
Services ki examples mein:
- Accounting and audit services
- Legal consultancy
- Engineering services
- Medical and professional services
- Architecture and design
- Other qualifying services
shamil ho sakti hain.
Employee ki salary aur independent service provider ko ki gayi payment ka tax treatment same nahi hota. Transaction ki actual nature identify karna zaroori hai.
3. Execution of Contracts — Section 153(1)(c)
Building contractors, construction firms, engineering contractors aur other qualifying contract payments par Section 153(1)(c) apply ho sakta hai.
Current law sportsperson ke signed contracts ko bhi relevant contract framework mein include karta hai, subject to the statutory wording.
Goods supply, services aur contract execution ko aik hi category mein merge na karein. Har transaction ke liye correct clause identify karna important hai.
Who Is a Prescribed Person Under Section 153?
Section 153 ke under har buyer automatically withholding agent nahi hota. Payment karne wale person ko prescribed-person definition mein fall karna chahiye.
Current Section 153(9) mein relevant categories include:
- Federal Government;
- Company;
- Association of Persons constituted by or under law;
- Non-profit organization;
- Foreign contractor or consultant;
- Consortium or joint venture;
- Exporter or export house for the specified services under subsection (1A);
- Association of Persons meeting the statutory turnover condition; and
- Individual meeting the statutory turnover condition.
| Category | Relevant Turnover Reference in Section 153(9) |
|---|---|
| AOP | Rs.50 million or above in Tax Year 2007 or any subsequent tax year |
| Individual | Rs.50 million or above in Tax Year 2009 or any subsequent tax year |
Section 153 mein turnover thresholds statutory drafting ke mutabiq hain. Payer ka legal structure aur relevant historical tax-year condition check karna zaroori hai.
Small Payment Thresholds
Current Section 153(1) contains specific aggregate thresholds for goods and services:
| Transaction | Statutory Aggregate Threshold |
|---|---|
| Sale / Supply of Goods | Less than Rs.75,000 in aggregate during a financial year |
| Rendering / Providing Services | Less than Rs.30,000 in aggregate during a financial year |
Goods aur services ke ye thresholds contract clause par automatically apply nahi kiye ja sakte. Section 153(1)(c) ko separately review karna chahiye.
How Are Section 153 Withholding Rates Determined?
Section 153 ke withholding rates First Schedule, Part III, Division III mein prescribed hote hain.
Exact rate determine karne ke liye following details relevant hain:
- Transaction goods, services ya contract mein se kis category mein hai;
- Recipient individual, AOP ya company hai;
- Recipient ka ATL status relevant date par kya tha;
- Applicable Tax Year ka rate schedule kya kehta hai;
- Koi specific statutory exemption, reduced rate ya special regime apply hota hai ya nahi.
Section 153 ke goods, services aur contract payments ki rates different ho sakti hain. Tax Year, recipient category, ATL status aur any special provision verify kiye baghair fixed rate use na karein.
Final Tax, Minimum Tax or Adjustable Tax?
Section 153 ke under deduct kiya gaya tax har recipient ke liye automatically same tax treatment nahi rakhta.
Section 153(6), its provisos, recipient category aur relevant First Schedule provisions determine karte hain ke deduction:
- Final Tax Regime ka hissa hai;
- Minimum Tax treatment rakhti hai; ya
- Normal tax computation mein adjustable credit ke taur par deal hoti hai.
Is liye withholding tax deduction ko automatically final liability ya automatically refundable tax assume na karein.
Section 153(4) & Section 159 — Exemption / Lower Rate Matters
Withholding tax se exemption ya reduced rate claim karne ke liye legal provision aur certificate procedure samajhna important hai.
Section 153(4) — Payment Without Deduction
Section 153(4) ke under payment ka recipient Commissioner ko application de sakta hai.
Commissioner required inquiry ke baad written order ke zariye kisi person ko payment without deduction of tax allow kar sakta hai.
Section 159 — Exemption or Lower Rate Certificate
Section 159 general exemption / lower-rate certificate ka provision hai.
Agar Commissioner satisfied ho ke relevant amount:
- Ordinance ke under tax se exempt hai; ya
- First Schedule mein specified rate se lower rate par taxable hai; ya
- relevant statutory conditions ke under 100% tax credit ke liye eligible hai,
to prescribed application procedure ke mutabiq exemption ya lower-rate certificate issue ho sakta hai.
Important Distinction:Section 153(4) aur Section 159 ko aik hi provision samajhna correct nahi.
Withholding agent ko applicable written order / certificate ki legal authority, validity, scope aur relevant transaction verify karni chahiye.
Sirf supplier ke kehne par tax deduction stop nahi karni chahiye.
Sections 160, 164 & 165 — Deposit, Certificate & Statements
Withholding agent ki responsibility sirf tax deduct karne tak limited nahi.
Section 160 — Payment of Tax Deducted or Collected
Deducted ya collected tax Commissioner ko prescribed time aur manner mein deposit karna hota hai.
CPR aur other accepted payment evidence ko relevant transaction ke sath properly preserve karein.
Section 164 — Certificate of Tax Deduction / Collection
Withholding agent ko tax deduct ya collect karte waqt recipient ko prescribed details ke sath tax certificate aur CPR ya equivalent document furnish karna hota hai.
Section 165 — Withholding Tax Statements
Applicable withholding agents ko prescribed withholding statements furnish karni hoti hain.
Statement, CPR, payment ledger aur vendor information ka reconciliation maintain karna important hai.
Practical Compliance Principle:Every deduction ko payment voucher, invoice, supplier record, applicable rate, CPR aur withholding statement ke sath reconcile karein.
Section 161 — Failure to Deduct or Pay Tax Collected / Deducted
Section 161 withholding agent ke default ki surat mein personal liability ka framework provide karta hai.
Default do important situations mein arise ho sakta hai:
1. Failure to Deduct or Collect
Agar prescribed person required tax deduct ya collect karne mein fail ho jaye, statutory liability arise ho sakti hai.
2. Tax Deducted but Not Deposited
Agar withholding agent supplier ki payment se tax deduct kar leta hai lekin Section 160 ke prescribed time aur manner mein deposit nahi karta, to Section 161 ke under liability arise ho sakti hai.
Personal Liability of Withholding Agent
Section 161 ke statutory framework ke under person personally liable ho sakta hai to pay the amount of tax to the Commissioner.
Commissioner recovery order pass kar sakta hai aur amount ko recover karne ki proceedings initiate kar sakta hai.
Right to Be Heard:Current Section 161(1A) ke mutabiq sub-section (1) ke under recovery se pehle concerned person ko opportunity of being heard provide karna zaroori hai.
Notice receive hone par transaction records, invoices, certificates, CPRs aur applicable exemptions ke supporting documents review karke proper reply prepare karein.
Section 162 — Recovery from the Person Who Received Payment
Section 162 withholding default ki situation mein tax recovery ka separate mechanism provide karta hai.
Agar person required tax collect ya deduct karne mein fail hota hai, to Commissioner statutory order ke zariye amount us person se recover kar sakta hai:
- Jis se tax collect hona chahiye tha; ya
- Jis ko payment ki gayi thi aur jahan se tax deduct hona chahiye tha.
Section 162(2) ke mutabiq recipient se recovery hone ki surat mein bhi failure to deduct karne wala person other legal action, default surcharge ya applicable expense-disallowance consequences se automatically absolved nahi hota.
Section 161 vs Section 162 — Difference
| Provision | Main Purpose |
|---|---|
| Section 161 | Failure to collect / deduct or failure to deposit the tax: personal liability of the person responsible for withholding default. |
| Section 162 | Recovery from the person from whom tax should have been collected or to whom the payment was made. |
Section 205 — Default Surcharge on Withholding Tax Default
Tax deduction ya collection required date par na ho, ya deducted / collected tax prescribed date tak Commissioner ko deposit na kiya jaye, to default surcharge ka issue arise ho sakta hai.
Withholding default ke liye Section 205(3) specifically 12% per annum default surcharge provide karta hai on the unpaid amount.
Section 205(3): 12% Per AnnumCalculation period generally us date se start hota hai jis date tax collect ya deduct karna required tha, aur us date tak continue karta hai jab amount Commissioner ko pay kar diya jaye.
Rate Clarification:Section 205(1) ka general default-surcharge formula unpaid tax, penalty aur other amounts ke liye 12% ya KIBOR plus 3% per annum, whichever is higher, provide karta hai.
Lekin withholding collection / deduction default specifically Section 205(3) ke under deal hota hai, jahan current statutory wording 12% per annum specify karti hai.
Why Timely Deposit Matters
- Tax deduction aur tax deposit ko alag compliance steps samjhein.
- CPR timely generate aur preserve karein.
- Short payment aur delayed payment differences identify karein.
- Vendor-wise and month-wise withholding reconciliation maintain karein.
Section 177 — Audit of Income Tax Affairs
Records and Documents That May Be Required
- Books of accounts;
- General ledger and trial balance;
- Sales and purchase registers;
- Bank statements;
- Supplier / vendor details;
- Purchase and sales invoices;
- Contracts and agreements;
- Withholding tax calculations;
- CPRs and payment evidence;
- Withholding tax statements;
- Exemption / lower-rate certificates;
- Tax returns and financial statements; and
- Relevant electronic records.
Electronic Records and Audit Proceedings
Section 177 mein electronic data aur records ke access ka framework bhi hai.
Audit proceedings applicable rules ke mutabiq electronic facilities or video links ke through bhi conduct ho sakti hain.
Written Reasons and Record Requisition
Current Section 177 ke relevant proviso ke mutabiq Commissioner record ya documents call karte waqt reasons writing mein record kar sakta hai, aur reasons taxpayer ko communicate karna required hai.
The Ordinance also contains a six-year limitation linked to the tax year to which the records relate for calling those records.
Audit Explanation and Report
Audit ke dauran taxpayer ko raised issues par explanation aur supporting evidence provide karne ka opportunity diya jata hai.
Section 177(6) ke framework mein Commissioner audit observations aur findings par audit report issue karta hai after obtaining taxpayer's explanation.
Incomplete Records and Sectoral Benchmark Ratios
Section 177(2AA) mein specific circumstances cover hain jahan taxpayer:
- Required record or books produce nahi karta;
- Incomplete records provide karta hai; ya
- Records ke defects par sufficient explanation nahi de pata.
Aisi situation mein statutory conditions ke mutabiq taxable income sectoral benchmark ratios ki basis par determine ki ja sakti hai.
Finance Act 2026 — Additional Audit Powers
Current Section 177(6B) complex or specialized cases mein additional audit / valuation mechanisms provide karta hai.
Where statutory conditions are met and required prior approval is obtained, Commissioner may direct:
- Accounts to be re-audited by an accountant;
- Inventory to be re-valued by a cost accountant; or
- Actuarial values to be determined by an actuary.
Relevant professional reports and taxpayer hearing requirements remain subject to the statutory provision.
Audit Outcome
Audit report khud automatically final tax demand nahi hoti.
Agar audit findings ki basis par assessment amendment necessary samjhi jaye, to Commissioner applicable legal process aur taxpayer hearing ke baad Section 122 ke under proceedings initiate kar sakta hai.
Section 214C — Computerized Selection for Audit by the Board
Section 214C Board ko computer ballot ke through persons ya classes of persons select karne ka power deta hai for audit of Income Tax affairs.
Selection ballot:
- Random; ya
- Parametric
ho sakta hai, as the Board deems fit under the statutory provision.
Confidential Selection Parameters
Section 214C(1A) ke under Board ko selection parameters confidential rakhne ka statutory requirement diya gaya hai.
Section 214C Audit Procedure
Section 214C ke under selected persons ka audit Section 177 ke procedure ke mutabiq conduct kiya jata hai.
Important Difference:Section 214C ke under Board ka computerized selection aur Section 177 ke under Commissioner ke audit powers separate statutory mechanisms hain.
Section 214C Commissioner ke independent powers under Section 177 ko restrict nahi karta.
Risk-Based Audit & FBR Audit Policy
FBR ka Audit Wing compliance-risk methodology aur annual audit policy / balloting ke through audit cases select karne ka role perform karta hai.
Unmatched records, withholding discrepancies aur unusual transactions tax risk review mein relevant ho sakte hain, lekin kisi aik discrepancy ko automatic audit-selection guarantee samajhna correct nahi.
Section 122 — Amendment of Assessments
Income Tax Return furnish hone ke baad Section 120 ke under assessment treated as issued ho sakti hai, provided return statutory requirements ke mutabiq complete ho.
Lekin aisi assessment har situation mein future amendment, audit ya other lawful proceedings se immune nahi hoti.
Section 122 Commissioner ko specified statutory grounds par assessment amend karne ka power deta hai.
Section 122(5) — Audit or Definite Information
Assessment amend ho sakti hai where, on the basis of audit or definite information, Commissioner satisfied ho ke:
- Income chargeable to tax assessment se escape ho gayi;
- Total income under-assessed hui;
- Income lower rate par assess hui;
- Excessive relief ya refund allow hua; or
- Amount ko incorrect head of income mein classify kiya gaya.
What Is Definite Information?
Section 122(8) ke under definite information mein relevant information include ho sakti hai about:
- Sales or purchases of goods;
- Receipts from services rendered;
- Other taxable receipts;
- Money or assets acquired, possessed or disposed of;
- Valuable articles or investments; and
- Expenditure incurred by the taxpayer.
Section 122(5A) — Erroneous and Prejudicial to Revenue
Commissioner Section 122(5A) ke under assessment amend ya further amend kar sakta hai where the order is considered:
Erroneous insofar as prejudicial to the interest of RevenueYeh statutory ground Section 122(5) ke definite-information / audit grounds se distinct hai.
Show Cause Notice & Right of Hearing
Section 122(9) taxpayer ko amendment se pehle opportunity of being heard provide karta hai.
Show Cause Notice ka reply dete waqt taxpayer ko:
- Relevant legal provision identify karni chahiye;
- Department ke proposed additions ko point-by-point address karna chahiye;
- Supporting evidence attach / furnish karna chahiye as prescribed;
- Reconciliation and calculations provide karni chahiye; and
- Applicable limitation and procedural objections raise karni chahiye.
Section 122 — Important Time Limits
General Amendment Limitation: Section 122(2) ke under original assessment amendment ka general time limit five years hai, calculated from the end of the financial year in which assessment order was issued or treated as issued.
Show Cause Notice to Order: Current Section 122(9) ke under amended order generally show-cause notice issue hone ke one year ke andar pass hona chahiye.
Section 122(9) written reasons ke sath limited extension allow karta hai, subject to a maximum 90-day extended period and the statutory exclusions for specified adjournments / proceedings.
Outdated 180-Day Rule:Purane articles mein 180 days plus 90-day extension quote hota hai. Finance Act 2025 ke amendment ke baad current general wording one year plus permitted extension ka framework provide karti hai.
Actual limitation calculate karte waqt notice date, assessment date, applicable version of the law aur excluded periods separately check karein.
Section 122E — Faceless Audit & Assessment
Finance Act 2026 ne Income Tax Ordinance mein Section 122E — Faceless Audit and Assessment introduce kiya hai.
Is provision ke under Board-specified persons, classes of persons, incomes, cases ya classes of cases ke liye following proceedings faceless manner mein conduct ki ja sakti hain, as prescribed:
- Audit under Sections 177 or 214C;
- Orders under Section 111;
- Assessments under the relevant Part; and
- Rectification under Section 221.
Section 122E automatically har taxpayer aur har audit par apply nahi hota. Board ki specified categories aur prescribed procedure ko check karna zaroori hai.
Where an opportunity of hearing is required in faceless audit, the provision also refers to E-hearing under Section 227E.
Audit vs Amendment of Assessment — Key Difference
| Compliance Point | Audit — Sections 177 / 214C | Amendment — Section 122 |
|---|---|---|
| Purpose | Examination and verification of taxpayer's tax affairs and records | Amendment of an assessment on statutory grounds |
| Initiating Mechanism | Commissioner audit or Board computer-ballot selection | Audit / definite information or erroneous and prejudicial assessment |
| Main Records | Books, invoices, bank data, contracts, ledgers and CPRs | Relevant evidence and legal reply to proposed amendment |
| Taxpayer Opportunity | Explanation of audit issues and production of records | Show Cause Notice response and opportunity of hearing |
| Possible Outcome | Audit observations and audit report | Amended assessment order and resulting tax consequences |
Audit aur assessment amendment related steps ho sakte hain, lekin dono aik hi legal proceeding nahi hain.

Does every business have to deduct tax under Section 153?
No. Section 153 applies to a prescribed person making a qualifying payment to a resident person. Payer category, transaction type, statutory thresholds and exemptions must be reviewed.
What are the three main categories under Section 153?
Supply of goods under Section 153(1)(a), rendering or providing services under Section 153(1)(b), and execution of contracts under Section 153(1)(c).
Are Section 153 goods and services payments subject to small-payment thresholds?
Yes. Current statutory wording provides aggregate thresholds of less than Rs.75,000 for goods and less than Rs.30,000 for services during a financial year. Contract payments should be examined separately.
Is Section 153(4) the same as a lower-rate certificate under Section 159?
No. Section 153(4) allows the Commissioner, after an application and inquiry, to authorize payment without deduction by written order. Section 159 separately deals with exemption or lower-rate certificates.
Is tax collected under Section 148 always adjustable?
No. Section 148(7) generally provides minimum-tax treatment for income arising from relevant imports, with a statutory exception for qualifying own-use imports by an industrial undertaking. Section 148(7A) separately specifies certain goods subject to minimum-tax treatment.
What happens if a withholding agent fails to deposit deducted tax?
Section 161 may make the person responsible personally liable to pay the amount to the Commissioner, subject to the statutory process and opportunity of being heard.
Can FBR recover withholding tax from the recipient?
Yes. Section 162 provides a recovery mechanism against the person from whom tax should have been collected or to whom the payment was made. This does not automatically absolve the withholding agent from other consequences.
What is the default surcharge for withholding tax default?
Section 205(3) provides a rate of 12% per annum for failure to collect or deduct tax or to pay the amount by the prescribed date. The calculation period is based on the statutory due and payment dates.
What is the difference between Sections 177 and 214C?
Section 177 deals with Commissioner audit powers. Section 214C allows the Board to select persons or classes of persons for audit through a computer ballot, random or parametric, with the audit then conducted under Section 177.
Does every audit automatically create an additional tax demand?
No. Audit findings must be considered under the relevant procedure. Where amendment is proposed, the applicable assessment-amendment provisions and taxpayer hearing rights must be followed.
How long does the Commissioner have to amend an assessment under Section 122?
The general limitation under Section 122(2) is five years from the end of the financial year in which the assessment was issued or treated as issued. Further amendments and the show-cause-to-order period have separate statutory rules and should be calculated from the actual case dates.
Does Section 122E apply to every taxpayer?
No. Faceless audit and assessment apply to persons, classes of persons, incomes or cases specified by the Board under the statutory framework and prescribed procedure.
