Assalam-o-Alaikum! AM Tax Hub ki Income Tax Ordinance, 2001 — A-to-Z Master Series ke Episode 10 mein aapka khair-maqdam hai.

Income tax return prepare karne se pehle taxpayer ka Resident ya Non-Resident status determine karna bohat important hai.

Tax residency citizenship, passport, CNIC, NICOP ya immigration status ka simple substitute nahi hai. Income Tax Ordinance har tax year ke liye specific statutory tests apply karta hai.

Is guide mein hum individual, company aur AOP residency ke rules, Pakistan-source income, foreign-source income aur non-resident businesses ke Permanent Establishment — PE concept ko practical Roman Urdu mein samjhein ge.

Resident vs Non-Resident Status Kyun Important Hai?

Income Tax Ordinance ke framework mein resident aur non-resident persons ka income scope different ho sakta hai.

Status General Tax Scope
Resident Person Subject to exemptions, special provisions and treaty relief, Pakistan-source aur foreign-source income dono tax computation mein relevant ho sakti hain.
Non-Resident Person Generally Pakistan-source income tax computation mein relevant hoti hai.
Important:

Resident status ka matlab yeh nahi ke har foreign receipt automatically double-taxed hogi.

Foreign income exemptions, foreign tax credits aur applicable Double Taxation Agreement — DTA — separately relevant ho sakte hain.

Section 81 — Resident & Non-Resident Persons

Section 81 basic tax-status framework provide karta hai.

A person relevant tax year ke liye resident person hota hai if that person is:

  • a Resident Individual;
  • a Resident Company;
  • a Resident Association of Persons; or
  • the Federal Government.

A person jo resident-person test satisfy nahi karta, relevant tax year ke liye Non-Resident Person hota hai.

Key Principle:

Tax residency permanent lifetime label nahi hai. Status ko har tax year ke facts ke mutabiq separately determine kiya jata hai.

Section 82 — Resident Individual

Individuals ke liye residency determine karne ka main statutory provision Section 82 hai.

1. 183-Day Physical Presence Rule

Individual resident individual hoga if relevant tax year mein Pakistan mein physical presence:

183 Days or More

ho.

Presence continuous hona zaroori nahi. Tax year ke tamam relevant visits ke qualifying days aggregate kiye jate hain.

Pakistan Tax Year

Normal tax year twelve months ending on 30 June hota hai.

Example:

Tax Year 2027 = 1 July 2026 to 30 June 2027

Pakistan Mein Days Kaise Count Hote Hain?

Income Tax Rules, 2002 ke Rule 14 ke under day counting ke important rules hain.

  • Pakistan mein kisi din ka part bhi generally whole day count hota hai.
  • Arrival day count hota hai.
  • Departure day count hota hai.
  • Public holidays aur qualifying leave days, jab individual Pakistan mein ho, count ho sakte hain.
  • A day spent in Pakistan solely in transit between two places outside Pakistan generally count nahi hota.
Best Practice:

Overseas taxpayers apne passport entry/exit records, tickets, boarding passes aur travel calendar preserve karein.

Government Employee Posted Abroad

Section 82 ke under Federal Government ya Provincial Government ka employee / official jo relevant tax year mein abroad posted ho, Resident Individual treat hota hai.

Is particular test ke liye normal 183-day physical presence condition satisfy karna required nahi.

Pakistani Citizen — Separate Residency Rule

Current Section 82 mein Pakistani citizens ke liye separate residency test bhi hai.

Pakistani citizen resident individual ho sakta hai if that person:

  • tax year mein kisi other country mein more than 182 days present na ho; or
  • kisi other country ka resident taxpayer na ho.
Overseas Pakistanis ke liye Important:

Sirf yeh dekhna ke aap Pakistan mein 183 days se kam rahe hain, har case mein non-resident conclusion ke liye enough nahi.

Pakistani citizen ko Section 82 ka citizen test bhi review karna chahiye.

Old 120-Day Rule — Is It Still Applicable?

No — current consolidated law mein old 120-day test active nahi hai.

Section 82 ka old clause (ab), jisme:

  • current tax year mein 120 days; plus
  • preceding four years mein aggregate 365 days

ka test tha, Finance Act 2021 ke through omitted ho chuka hai.

Is liye purani websites, articles aur videos ke 120 + 365 rule ko current filing mein automatically use na karein.

Practical Individual Residency Examples

Example 1 — 190 Days in Pakistan

Ali relevant tax year mein aggregate 190 days Pakistan mein present raha.

Section 82(a) ka 183-day threshold satisfy hota hai.

Result: Resident Individual.

Example 2 — 150 Days in Pakistan

Sara Pakistan mein 150 days rahi.

Sirf 183-day rule fail hone ki wajah se automatically final non-resident conclusion nahi nikala ja sakta, especially if she is a Pakistani citizen.

Section 82 ka citizen test bhi separately evaluate karna hoga.

Example 3 — Government Official Abroad

Federal Government ka official poora tax year official posting ke liye overseas raha.

Section 82(c) ka separate resident-individual rule relevant hoga.

Section 83 — Resident Company

Company resident company hoti hai if any applicable statutory condition is satisfied.

1. Pakistan Incorporation / Formation

Company agar Pakistan mein applicable law ke under incorporated ya formed hai to resident-company treatment apply hota hai.

2. Control & Management

Foreign-incorporated company bhi Pakistan resident company ho sakti hai if company ke affairs ka:

Control & Management Wholly in Pakistan

tax year ke dauran kisi bhi waqt situated ho.

3. Provincial or Local Government

Applicable statutory framework Provincial Government aur Local Government ko bhi resident-company definition mein cover karta hai.

Control & Management:

Sirf registered office, bank account ya isolated board meeting ko dekh kar residency conclusion nahi nikalna chahiye.

Actual strategic control and management ke complete facts examine karna zaroori hai.

Section 84 — Resident Association of Persons

Association of Persons ke liye company se different test apply hota hai.

AOP relevant tax year mein resident hoti hai if its affairs ka control and management:

Wholly or Partly in Pakistan

tax year ke dauran kisi bhi waqt situated ho.

Company vs AOP:

Company ke Section 83 test mein “wholly” important hai.

AOP ke Section 84 test mein “wholly or partly” use hota hai.

Non-Resident Status & Section 101 Pakistan-Source Income

Person jo applicable resident tests satisfy nahi karta, relevant tax year ke liye non-resident ho sakta hai.

Non-resident ki Pakistan tax computation mein generally Pakistan-source income relevant hoti hai.

Depending on facts, Pakistan-source income mein examples include:

  • Pakistan mein exercised employment se salary;
  • Pakistan business operations or PE attributable income;
  • certain Pakistan-source dividend / profit-on-debt receipts;
  • royalties or fees for technical services where source rules apply;
  • Pakistan immovable property rent;
  • Pakistan property / asset gains where relevant law applies.
Common Misconception:

Non-resident hone ka matlab yeh nahi ke Pakistan mein koi tax obligation hi nahi ho sakti.

Pakistan-source income separately evaluate karni hoti hai.

Resident Taxpayer & Foreign Income — Related Reliefs

Resident status determine hone ke baad foreign-source income ka treatment separately check kiya jata hai.

Section 50 — Short-Term Resident Individuals

Certain qualifying individuals jo employment ki wajah se short-term basis par Pakistan resident bante hain, specified foreign-source income exemption ke liye eligible ho sakte hain, subject to statutory conditions.

Section 51 — Returning Expatriates

Qualifying Pakistani citizen jo preceding tax years mein non-resident raha ho aur Pakistan return kare, Section 51 ke applicable conditions ke under foreign-source income relief claim kar sakta hai.

Section 103 — Foreign Tax Credit

Where qualifying resident taxpayer ne taxable foreign-source income par foreign income tax pay kiya ho, Section 103 ke under foreign tax credit potentially available ho sakta hai.

Credit generally statutory limit ke subject hota hai.

DTA Check:

Cross-border cases mein Pakistan ka relevant country ke sath Double Taxation Agreement bhi review karein.

Permanent Establishment — Section 2(41)

Foreign company ya other non-resident business Pakistan mein resident na hone ke bawajood Pakistan mein Permanent Establishment — PE create kar sakta hai.

PE aur tax residency two separate concepts hain.

Current domestic law mein PE broadly place of business ke through wholly or partly carried-on business aur specifically listed situations ko cover karta hai.

Common Permanent Establishment Categories

Depending on facts, current domestic PE definition mein following situations relevant ho sakti hain:

  • place of management;
  • branch;
  • office;
  • factory;
  • workshop;
  • warehouse;
  • sales outlet;
  • mine, oil or gas well;
  • natural-resource extraction site;
  • agricultural, pastoral or forestry property;
  • construction / installation activity;
  • services and consultancy;
  • dependent agents;
  • substantial equipment or machinery; and
  • virtual business presence.

Virtual Business Presence — Important Modern PE Rule

Pakistan ke current domestic PE framework mein physical office hamesha necessary nahi.

Current Section 2(41) specifically virtual business presence in Pakistan ko PE definition mein include karta hai.

Is mein internet ya another electronic medium ke through business transactions, with or without physical presence, relevant ho sakti hain.

Foreign Digital Businesses:

“Pakistan mein office nahi hai” alone PE risk ko eliminate nahi karta.

Lekin where applicable, relevant Double Taxation Agreement ka PE definition domestic rule se different ho sakta hai.

Construction, Assembly & Installation PE

Building site, construction, assembly, installation project aur related supervisory activities current domestic PE definition ke under relevant hain.

Domestic-law duration test applicable circumstances mein:

More Than 90 Days Within Any 12-Month Period

ho sakta hai.

Treaty Reminder:

Applicable DTA ka construction-site threshold different ho sakta hai. Always domestic law and treaty dono check karein.

Service & Consultancy PE

Current PE definition furnishing of services, including consultancy services, through employees, personnel or relevant entity ko bhi cover karti hai.

Important:

Domestic service-PE clause mein construction clause ka 90-day threshold automatically copy na karein.

Specific treaty mein separate service duration threshold ho sakta hai.

Dependent Agent PE

A person acting in Pakistan on behalf of a non-resident can, depending on actual facts, PE exposure create kar sakta hai.

Examples include agent who habitually:

  • contracts conclude karta ho;
  • contract conclusion mein principal role play karta ho;
  • specified goods stock maintain karke regular deliveries karta ho; ya
  • enterprise ke business ko relevant statutory manner mein conduct karta ho.

Independent-agent exclusions aur complete statutory conditions bhi separately review karni hoti hain.

Section 105 — Taxation of a Pakistan PE

Section 105 non-resident person ki Pakistan PE ke business income computation ke important rules provide karta hai.

PE attributable income determine karte waqt PE ko computation purposes ke liye is basis par consider kiya jata hai as if it were:

A Distinct & Separate Person Dealing Independently Important Legal Distinction:

Iska matlab yeh nahi ke PE automatically separate incorporated company ban jati hai.

Yeh primarily income attribution / tax-computation principle hai.

PE Expenses

Subject to the Ordinance, business activities ke liye qualifying expenditure deductible ho sakta hai.

Head Office Charges

Head-office allocations, internal royalty, fees, profit on debt aur similar amounts par Section 105 specific restrictions contain karta hai.

Is the old 120-day rule still active?

No. Old Section 82(ab) Finance Act 2021 ke through omitted ho chuka hai.
