Assalam-o-Alaikum! AM Tax Hub ki Income Tax Ordinance, 2001 — A-to-Z Master Series ke Episode 11 mein aapka khair-maqdam hai.

Income Tax Return file karna sirf income ki aik figure FBR ko report kar dene ka naam nahi hai. Proper tax compliance mein income, tax payments, assets, liabilities, personal expenses aur sources of wealth ko aik doosre ke sath properly reconcile karna zaroori hota hai.

Is episode mein hum Section 114 Return of Income, Section 116 Wealth Statement, Section 116A Foreign Income & Assets Statement, Section 118 filing dates, Section 120 assessment, Section 181 registration aur ATL framework ko practical Roman Urdu mein samjhein ge.

Section 114 — Who Is Required to File a Return of Income?

Section 114 Pakistan ke annual income-tax filing framework ka central provision hai.

Law different categories of persons ko return furnish karne ka obligation impose karta hai.

Every Company

Every company Section 114 ke statutory filing framework mein covered hai.

Taxable Income Above the Non-Taxable Limit

Company ke ilawa woh person jis ki taxable income relevant tax year ke maximum non-taxable amount se exceed karti ho, return filing requirement mein aa sakta hai.

Non-Profit Organizations

Qualifying non-profit organizations bhi Section 114 ke return-filing framework mein expressly covered hain.

Income Subject to Final Taxation

Current Section 114 certain persons whose income is subject to final taxation ko bhi return-filing framework mein include karta hai.

Return Filing Obligation Income Threshold Se Bhi Aage Ja Sakti Hai

Ye bohat common misconception hai ke:

“Mera tax payable zero hai, is liye mujhe return file nahi karni.”

Section 114 mein taxable-income threshold ke ilawa bhi multiple statutory triggers maujood hain.

Previously Charged to Tax

Certain persons jo preceding tax years mein tax ke liye charge ho chuke hon, filing requirement mein aa sakte hain.

Carry-Forward Loss

A person jo tax loss carry forward claim karta hai, return filing requirement ko properly consider kare.

Immovable Property

Section 114 different location and property-size tests contain karta hai.

For example, relevant municipal / cantonment / Islamabad Capital Territory situations mein ownership of:

  • specified land of 500 square yards or more; or
  • applicable flat ownership

return-filing obligation create kar sakti hai.

Rating areas ke liye separate land and covered-area thresholds bhi statute mein provided hain.

Motor Vehicle

Current statutory wording vehicle having engine capacity above 1000cc ko relevant filing trigger ke taur par include karti hai.

National Tax Number

Person who has obtained National Tax Number bhi applicable Section 114 conditions ke under filing requirement mein aa sakta hai.

Commercial or Industrial Electricity Connection

Relevant commercial or industrial electricity connection holder jiska annual bill statutory threshold se exceed kare, return-filing obligation mein aa sakta hai.

Professional / Trade Body Registration

Certain resident persons registered with Chambers of Commerce, trade/business associations, market committees ya specified professional bodies bhi filing framework mein covered ho sakte hain.

Important:

Return filing obligation ko sirf salary ya business income ki amount dekh kar determine na karein. Section 114 ke complete statutory triggers check karein.

Business Income — Additional Filing Rule

Section 114 mein individual business income ke liye bhi specific filing provision hai.

Applicable current law ke mutabiq business income ke relevant statutory band mein fall karne wala individual bhi return filing requirement mein aa sakta hai even where ordinary taxable-income threshold test independently apply na kare.

Is liye sole proprietors ko “tax payable nahi bana” ke basis par filing obligation ignore nahi karni chahiye.

FBR IRIS — Electronic Return Filing

Current Section 114 electronic filing framework ko expressly recognize karta hai aur returns prescribed manner mein IRIS ke through file ki jati hain.

Return ko complete karte waqt taxpayer ko relevant:

  • income particulars;
  • business information where applicable;
  • tax deductions / credits;
  • tax payment evidence;
  • wealth statement where required; and
  • foreign income and assets statement where applicable

properly review karne chahiye.

Companies — Finance Act 2026 Update:

Tax Year 2026 onwards, company financial statements accompanying the return are subject to the current electronic-readable-format requirement under Section 114.

Section 116 — Wealth Statement & Wealth Reconciliation

Wealth Statement Income Tax Return ka one of the most important compliance components hai.

Current Section 116 ke mutabiq every resident taxpayer being an individual who files a return for a tax year shall furnish:

  • Wealth Statement; and
  • Wealth Reconciliation Statement

for that tax year along with the return.

Important AOP Update:

Current Section 116 also requires every member of an Association of Persons to furnish a wealth statement and wealth reconciliation for the year along with the return of the association.

What Goes Into a Wealth Statement?

1. Assets

Depending on taxpayer facts, assets can include:

  • Residential and commercial properties;
  • Plots and land;
  • Bank accounts;
  • Cash in hand;
  • Vehicles;
  • Investments;
  • Shares and securities;
  • Receivables / advances;
  • Business capital;
  • Foreign assets; and
  • Other movable or immovable assets.

2. Liabilities

Liabilities can include:

  • Bank loans;
  • Mortgage / finance balances;
  • Personal borrowings;
  • Payables; and
  • Other genuine outstanding liabilities.

3. Personal Expenses

Relevant household / personal expenses may include:

  • Utilities;
  • Education;
  • Medical expenses;
  • Rent;
  • Travel;
  • Vehicle expenses;
  • Household costs; and
  • Other personal expenditure.

Spouse & Dependents — Important Wealth Statement Rule

Section 116 requires specified information relating to spouse, minor children and other dependents.

Current Clarification:

For spouse's assets, current law clarifies that spouse assets are included in the taxpayer's wealth statement where the spouse is dependent.

Family wealth reporting ko therefore relationship alone se nahi, applicable dependency status aur current form requirements ke sath review karna chahiye.

Wealth Reconciliation — The Most Important Cross-Check

FBR Wealth Statement ka purpose sirf asset list banana nahi hai. Taxpayer ko ye bhi explain karna hota hai ke wealth mein movement kahan se aayi.

Closing Net Wealth = Opening Net Wealth + Net Explainable Inflows − Relevant Outflows

Practical reconciliation mein factors include ho sakte hain:

  • Taxable income;
  • Exempt income;
  • Foreign remittances;
  • Gifts, where genuine and properly supported;
  • Inheritance;
  • Asset sales / purchases;
  • Liability movements;
  • Personal expenses; and
  • Other documented inflows or outflows.
Unreconciled Difference:

A significant unexplained wealth difference ko ignore karna prudent approach nahi hai.

Depending on facts, unexplained assets, money or expenditure may create issues under provisions including Section 111.

Open Wealth Statement Tool → Tool Disclaimer:

This is an informational planning and reconciliation tool. It is not an FBR assessment and does not replace verification of actual taxpayer records and applicable law.

Section 116A — Foreign Income & Assets Statement

Section 116A ka application har resident individual par automatically nahi hota.

Current law ke mutabiq relevant statement required ho sakti hai where a resident taxpayer being an individual has:

Trigger Current Statutory Threshold
Foreign Income Not less than USD 10,000
Foreign Assets Value not less than USD 100,000

Where applicable, statement covers matters including:

  • total foreign assets and foreign liabilities;
  • foreign assets transferred during the tax year;
  • consideration received for transfer;
  • foreign income particulars; and
  • relevant expenditure relating to deriving foreign income.

Section 118 — Return Filing Due Dates

Section 118 statutory filing-date framework provide karta hai.

Taxpayer Category General Statutory Due Date
Person other than a company Generally 30 September following the end of the relevant tax year
Company with tax year ending between 1 January and 30 June Generally 31 December following the end of that tax year
Other company cases Generally 30 September following the end of the tax year
Do Not Treat These Dates as a Standalone Live Deadline Notice:

Extensions may be granted under applicable statutory powers. Before relying on a deadline, check the latest Tax Year and FBR notification / extension.

Income Tax Return ke ilawa withholding statements, advance tax, Sales Tax aur other compliance deadlines ko track karne ke liye AM Tax Hub Tax Calendar use karein.

Section 120 — Assessment on Filing of a Complete Return

Section 120 mein complete Return of Income furnish hone par assessment mechanism provided hai.

Broadly, where a taxpayer furnishes a complete return covered by Section 120, Commissioner is treated as having made an assessment of taxable income and tax under the statutory framework.

Important:

Iska matlab ye nahi ke taxpayer ki return future review se permanently immune ho gayi.

Where legal conditions are met, audit, amendment, best-judgment or other statutory proceedings separately arise kar sakti hain.

What Makes a Return “Complete”?

Section 114 and Section 120 ko together read karte waqt completeness bohat important hai.

Applicable case ke mutabiq return should properly contain / accompany:

  • prescribed return particulars;
  • relevant income information;
  • evidence of due tax payment where applicable;
  • wealth statement where required;
  • foreign income and assets statement where required;
  • required annexures / statements; and
  • prescribed business or financial information.

Blank, irrelevant ya materially incomplete information future compliance and penalty exposure create kar sakti hai.

Section 181 — Taxpayer Registration & NTN

Section 181 taxpayer registration ka core provision hai.

Every taxpayer ko prescribed manner mein registration requirements consider karni hoti hain.

Individuals:

Tax Year 2015 onwards, individual having a NADRA-issued CNIC ke case mein the CNIC is used as the National Tax Number.

E-Commerce Registration — Current Rule

Current Section 181 also contains registration requirements relating to persons selling digitally ordered goods or services from within Pakistan through online marketplaces or courier services.

Section 181A & ATL — Active Taxpayer Status

Section 181A gives the Board power to institute and regulate the Active Taxpayers' List — ATL.

ATL status aur return filing related hain, lekin NTN registration aur ATL status same thing nahi hain.

Simple Difference:

NTN / Registration: taxpayer registration identity.
ATL: relevant return-filing / prescribed active-status framework.

FBR ATL is currently updated on a daily basis, which allows qualifying taxpayers' status to reflect more promptly.

Check ATL / Filer Status by CNIC or NTN

AM Tax Hub ATL Verification tool se imported FBR ATL dataset mein CNIC ya NTN search kiya ja sakta hai.

Check ATL / Filer Status → Important Verification Note:

AM Tax Hub independently maintained / imported ATL dataset use karta hai. Property, vehicle, banking ya other material transaction se pehle current status FBR se bhi confirm karein.

Late Return Filing — Section 182 Penalty

Late filing ka consequence sirf filer-status issue tak limited nahi. Section 182 current penalty regime contain karta hai.

Current provision mein late Return of Income ke liye penalty broadly higher of:

  • 0.1% of tax payable for each day of default; or
  • Rs.1,000 for each day of default

ke statutory mechanism par based hai, subject to current minimum and maximum rules.

Current Minimum Penalties

  • Rs.10,000 where an individual's income consists of 75% or more salary income; and
  • Rs.50,000 in other applicable cases.

Current law also provides reduction in penalty where return is filed within specified periods after the due / extended due date.

Important:

Purane articles mein commonly quoted flat Rs.40,000 minimum penalty current 2026 provision ko accurately reflect nahi karti.

Section 182A — Late Filing & ATL Inclusion

Agar required Section 114 return due date / valid extended date tak file na ho, Section 182A additional consequences provide karta hai.

ATL Inclusion After Late Filing

Late return filer current statutory conditions satisfy karke ATL mein include ho sakta hai.

Finance Act 2026 ke baad current surcharge amounts are:

Taxpayer Current ATL Late-Inclusion Surcharge
Individual Rs.25,000
Association of Persons Rs.50,000
Company Rs.100,000
Finance Act 2026 — Individual Option:

Current Section 182A also contains a specific provision under which the surcharge condition may not apply to an individual who furnishes the prescribed undertaking that the individual will not purchase, acquire or otherwise obtain ownership / beneficial interest in property for six months from the undertaking date.

Before relying on this option, current prescribed procedure should be verified.

Other Consequences Under Section 182A

Depending on circumstances, Section 182A also contains restrictions relating to:

  • carry forward of losses;
  • refund issuance while the person is not included in ATL; and
  • additional payment on delayed refund for the relevant period.

Why ATL Status Matters

Pakistan's Income Tax Ordinance contains different withholding and tax treatment for persons depending on ATL status in a number of transactions.

Depending on the relevant Tax Year and transaction, ATL status can affect areas such as:

  • property purchase and sale;
  • vehicle-related transactions;
  • banking transactions;
  • investments;
  • commercial payments; and
  • other withholding-tax provisions.
Do Not Use One Generic “Double Tax” Rule:

Non-ATL consequences vary by section and transaction. Current rate card and applicable provision should be checked instead of assuming every transaction simply becomes “double tax”.

Common Return Filing & Wealth Statement Mistakes

  • Filing income correctly but leaving wealth unreconciled;
  • Ignoring liabilities while calculating net wealth;
  • Under-reporting household expenses;
  • Showing property or vehicle acquisition without an explainable source of funds;
  • Not carrying forward correct opening wealth;
  • Failing to report applicable foreign income / assets;
  • Assuming every person with a foreign asset must file Section 116A without checking statutory thresholds;
  • Confusing NTN registration with ATL status;
  • Using outdated ATL surcharge figures;
  • Assuming every Non-ATL rate is simply “double” the ATL rate;
  • Filing blank or materially incomplete return information;
  • Ignoring current FBR extensions / notifications when checking due dates.

Frequently Asked Questions

Do I need to file a return if no tax is payable?

Possibly yes. Section 114 contains several filing triggers beyond taxable income alone, including specified assets, registration and other statutory circumstances.

Does every company have to file a Return of Income?

Section 114 expressly includes every company in its return-filing framework.

Does every AOP automatically have to file regardless of its facts?

AOP filing requirement should be determined under Section 114's applicable statutory triggers. Do not simply treat the company rule as automatically identical for every AOP.

Is Wealth Statement compulsory for a resident individual filing a return?

Current Section 116 requires a resident taxpayer being an individual filing a return to furnish Wealth Statement and Wealth Reconciliation for that tax year.

Do AOP members have Wealth Statement obligations?

Yes. Current Section 116 also contains a requirement for every member of an AOP to furnish wealth statement and reconciliation along with the return of the association.

Does every foreign bank account trigger Section 116A?

Not automatically. Current Section 116A contains statutory thresholds: foreign income of at least USD 10,000 or foreign assets with value of at least USD 100,000 for a resident individual taxpayer.

What is Section 120 assessment?

Where a complete return falls within Section 120, the Commissioner is treated as having made the relevant assessment under the statutory mechanism. This does not prevent later proceedings where permitted by law.

Is CNIC used as NTN for an individual?

For Tax Year 2015 onwards, current Section 181 provides that a NADRA-issued CNIC is used as National Tax Number for an individual.

Is NTN the same as ATL filer status?

No. Registration / NTN and inclusion in the Active Taxpayers' List are different concepts.

Can a late filer become active on ATL?

Yes, subject to current Section 182A requirements. Late filing may require the applicable surcharge or, for qualifying individuals, the current statutory undertaking mechanism may be relevant.
